Separate and clear
If you decide to separate but choose not to divorce, we always advise that you set out the terms of any financial agreement in a legally binding document, known as a Separation Agreement.
These are not referred to court for approval but if you later decide to divorce, there are limited circumstances where a court would refer to the earlier agreement.
