Some clients want to make legally binding agreements to protect themselves before they get married.
Although popular in the U.S., these Prenuptial Agreements, as they are known, are not currently binding in England and Wales.
However, this is a rapidly changing area of law and in many cases a Prenuptial Agreement will influence a court’s decision.
All such agreements must meet the following conditions:
- Both parties must have independent legal advice.
- Both parties must make a full financial disclosure.
It is advisable for agreements to be made a minimum of three weeks before marriage.
